Terms and Conditions

Welcome to the Terms and Conditions (these "Terms") for the MangaHub mobile application (the "App") and any content, tools, features, and functionalities offered through the App (collectively, the "Services"). These Services are provided by Alvaro ("I", "me", "we"), an independent developer based in Spain.

These Terms govern your access to and use of the Services. Please read these Terms carefully, as they include important information about your legal rights. By accessing and/or using the Services, you are agreeing to these Terms. If you do not understand or do not agree to these Terms, please do not use the Services.

For purposes of these Terms, "you" and "your" means you as the user of the Services.

1. The Services

1.1 Description of the Service

MangaHub is a manga collection management application that allows you to organize, track, and discover manga. The Services include features such as:

- Manga collection management with full metadata tracking - Value and price tracking with real-time market data from eBay - Professional grading tracking (Beckett Grading Services) - Reading list management with progress tracking - Manga discovery with personalized recommendations - ISBN barcode scanning for quick item addition - Collection analytics with charts and statistics - Custom collections with icons and colors

1.2 Price and Value Information

As part of the Services, you may view estimated market values and price history for manga volumes ("Price Data"). The Services use third-party data sources, including eBay sold listings, to generate these estimates ("Output"). Any collection data you enter will be considered "Your Content" under these Terms.

By using the Price Data features, you acknowledge that price estimates are approximations and may not reflect actual market conditions at any given time.

1.3 Important Notice

MANGAHUB IS NOT A FINANCIAL ADVISORY SERVICE AND DOES NOT PROVIDE INVESTMENT ADVICE, APPRAISALS, OR PROFESSIONAL VALUATIONS.

Price estimates and market values displayed in the App are derived from third-party sources and are provided for informational purposes only.

Always conduct your own research before making any purchase or sale decisions based on price data displayed in the App. MangaHub is not responsible for any financial decisions made based on information provided through the Services.

1.4 Eligibility

You must be at least 13 years of age to use the Services. Minors who have not reached the age of majority in their jurisdiction, but who are at least 13 years old, may only use the Services if the minor's parent or guardian accepts these Terms on behalf of the minor before using the Services. Children under 13 years of age are not permitted to use the Services. By using the Services, you represent and warrant that you meet these requirements.

2. User Accounts and Subscriptions

2.1 Creating and Protecting Your Account

To use the Services, you need to create an account by linking your Apple or Google account ("Account"). You agree to provide me with accurate, complete, and up-to-date information for your Account. You are solely responsible for any activity on your Account and for maintaining the confidentiality and security of your login credentials. I am not responsible for any act or omission on your part in connection with your Account.

You must notify me immediately at hello@getmangahub.com if you know or have any reason to suspect that your Account has been compromised, or in the event of any actual or suspected unauthorized use of your Account.

2.2 Free and Paid Services

Some of the Services are free with limited functionality (up to 50 items, 3 collections, 5 ISBN scans per month, and limited price history). If you subscribe to MangaHub Pro, you agree to pay the applicable fees through Apple App Store.

Subscriptions are managed entirely through Apple's platform. I do not directly process or store credit card information or financial data; these are managed by Apple according to their own terms and policies.

2.3 Subscription Renewals and Cancellations

Subscriptions automatically renew according to the selected period (monthly or annual) unless you cancel at least 24 hours before the renewal date. To cancel your subscription:

iOS: Go to Settings > Your name > Subscriptions > MangaHub > Cancel subscription

After any cancellation, you will continue to have access to paid features until the end of the subscription period already paid for.

2.4 Right of Withdrawal (European Union Users)

In accordance with European consumer protection regulations, you have the right to withdraw from your purchase within 14 days from the date of subscription, without giving any reason.

Important: Subscriptions and in-app purchases are made through Apple App Store. Therefore:

- The purchase contract is established directly between you and Apple. - The right of withdrawal and refund requests must be handled directly with Apple through their official channels. - As a developer, I do not process payments directly and do not have the technical ability to manage refunds.

How to request a refund:

iOS (Apple): Visit reportaproblem.apple.com or contact Apple support.

By starting to use the paid Services and accessing the digital content immediately, you acknowledge that the digital content begins to be delivered before the 14-day withdrawal period ends. Apple refund policies will apply in all cases.

2.5 Refund Policy

Refunds are governed entirely by Apple App Store policies. If you have any issues with your subscription, please contact Apple support directly. You may also write to me at hello@getmangahub.com for any related inquiries.

3. Privacy Policy

My Privacy Policy describes how I handle the information you provide to me when you use the Services, including your Collection Data. We recommend reading our Privacy Policy available in the App or on the application page in the app stores.

4. Rights I Grant You

4.1 Right to Use the Services

I allow you to use the Services only for your personal and non-commercial use, as long as you comply with these Terms. I grant you a personal, non-assignable, non-sublicensable, non-transferable, and non-exclusive right and license to access and use the App and the Services provided, for the sole purpose of enabling you to use the Services as permitted by these Terms.

Your access to and use of the Services may be interrupted from time to time for reasons including, without limitation, maintenance, updates, repairs, or other actions I may take.

4.2 Restrictions on Your Use of the Services

You may not do any of the following in connection with your use of the Services, unless applicable laws or regulations prohibit these restrictions or you have my written permission:

- Download, modify, copy, distribute, transmit, display, perform, reproduce, duplicate, publish, license, create derivative works from, or offer for sale any information contained in the Services, except as expressly permitted in these Terms.

- Duplicate, decompile, reverse engineer, disassemble, or decode the Services, or attempt to do the same.

- Use, reproduce, or remove any copyright, trademark, or other proprietary notation displayed on or through the Services.

- Use automation software (bots), hacks, modifications, or other unauthorized software designed to modify the Services.

- Exploit the Services for any commercial purpose, including scraping price data or manga metadata for resale.

- Access or use the Services in any way that could disable, overburden, damage, or interfere with the Services or any other party's access.

- Attempt to gain unauthorized access to the Services, other users' accounts, or systems connected to the Services.

- Circumvent, remove, alter, or disable any technological measures or protections of the Services.

- Use any robot, spider, crawler, or other automatic device to extract, scrape, or collect information from the Services.

- Introduce any virus, trojans, worms, or other malicious or technologically harmful materials.

- Use the Services to send, transmit, or store any content that is illegal, defamatory, obscene, violent, harassing, abusive, hateful, or that incites violence or criminal activities.

- Violate any applicable law or regulation in connection with your access to or use of the Services.

5. Ownership and Content

5.1 Ownership of the Services

The Services, including their design, text, graphics, logos, proprietary content, information, and other materials, are protected under copyright, trademark, and other intellectual property laws. You agree that I own all rights, title, and interest in and to the Services (including all intellectual property rights) and you agree not to take any action inconsistent with such ownership interests.

5.2 Trademark Ownership

The name "MangaHub", trademarks, logo, and all related names, logos, designs, and visual elements are my property. Other names, logos, and designs that appear on the Services are the property of their respective owners.

5.3 Feedback and Suggestions

I welcome feedback and suggestions for improvements to the Services ("Feedback"). You agree that any contribution of Feedback will not grant you any right, title, or interest in the Services or in such Feedback. All Feedback becomes my property, and I may use and disclose Feedback in any manner and for any purpose without prior notice or compensation to you.

5.4 Your Content

In connection with your use of the Services, you may post, upload, or submit content, including Collection Data and Reading Data ("Your Content"). As between you and me, I do not claim any ownership of Your Content; however, I own and continue to own the Services and any software or technology used to process Your Content.

In order to operate the Service, you grant me a license to access, use, host, store, copy, reproduce, transmit, display, publish, distribute, and modify Your Content to operate, improve, and provide the Services. This license includes the right to make Your Content available to third-party service providers with whom I have contractual relationships related to the provision of the Services (such as cloud storage providers).

You agree that these rights and licenses are royalty-free, worldwide, and irrevocable (for as long as Your Content is stored with me).

To the maximum extent permitted by applicable law, I reserve the right to remove, filter, edit, or delete any of Your Content at any time, for any reason, and without prior notice. By posting Your Content through the Services, you represent and warrant that you have all necessary rights to grant the rights described herein.

6. Third-Party Services and Materials

6.1 Use of Third-Party Services

The Services use third-party technologies and services, including:

- Supabase: For data storage and authentication - RevenueCat: For subscription management - Apple: For authentication and payment processing - eBay API: For market price data and sold listings - AniList API: For manga metadata - MangaDex: For manga cover images

By using the Services, you acknowledge and agree that I am not responsible for examining or evaluating the content, accuracy, availability, or any other aspect of these third-party services. I do not warrant or endorse these services and assume no responsibility for them.

6.2 Price Data Sources

Market values and price estimates in the Services are based on data from eBay sold listings and other third-party sources. These estimates are informational only and do not substitute professional appraisals or valuations. Price data may be delayed, incomplete, or inaccurate and may not reflect the latest market conditions.

7. Disclaimers and Limitations of Liability

7.1 Disclaimers

Your access to and use of the Services is at your own risk. You understand and agree that the Services are provided to you on an "AS IS" and "AS AVAILABLE" basis. Without limiting the foregoing, to the maximum extent permitted under applicable law, I DISCLAIM ALL WARRANTIES AND CONDITIONS, WHETHER EXPRESS OR IMPLIED, OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

I do not warrant or take responsibility for:

- The completeness, accuracy, availability, security, or reliability of the Services. - Any damage to your device, loss of data, or other damage resulting from your access to or use of the Services. - Operation or compatibility with any other system or device. - Whether the Services will meet your requirements or be available on a continuous, secure, or error-free basis. - The deletion of, or failure to store or transmit, Your Content. - The accuracy of price estimates, market values, or any other information generated by the Services.

I ASSUME NO RESPONSIBILITY FOR ANY CONTENT THAT YOU, ANOTHER USER, OR A THIRD PARTY CREATES, UPLOADS, POSTS, SENDS, RECEIVES, OR STORES ON OR THROUGH THE SERVICES.

7.2 Limitations of Liability

TO THE EXTENT NOT PROHIBITED BY LAW, YOU AGREE THAT IN NO EVENT WILL I BE LIABLE FOR DAMAGES OF ANY KIND, INCLUDING INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF USE, DATA, OR PROFITS, BUSINESS INTERRUPTION, OR ANY OTHER DAMAGE OR LOSS), ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES.

TOTAL LIABILITY TO YOU FOR ANY DAMAGES WILL NOT EXCEED THE SUM OF ONE HUNDRED EUROS (100.00 EUR), OR THE AMOUNT YOU HAVE PAID IN THE LAST TWELVE (12) MONTHS FOR THE SERVICES GIVING RISE TO THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE LIMITATIONS MAY NOT APPLY, AND YOU MAY HAVE ADDITIONAL RIGHTS.

7.3 Indemnification

By accepting these Terms and using the Services, you agree to defend, indemnify, and hold me harmless from and against any claims, costs, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or in connection with:

- Your violation of these Terms or any applicable law or regulation. - Your violation of the rights of any third party. - Your misuse of the Services. - Your Content.

8. Termination

8.1 Termination by You

You may stop using the Services at any time. You may delete your Account from the App settings or by contacting me at hello@getmangahub.com.

8.2 Termination by Me

If you violate any provision of these Terms, all licenses granted will automatically terminate. Additionally, I may suspend, disable, or delete your Account and/or access to the Services with or without notice, for any reason or no reason.

If I delete your Account for any suspected violation of these Terms, you are prohibited from creating a new account.

In the event of Account deletion for any reason, I may delete Your Content. I will not be liable for failure to delete or for deleting Your Content.

8.3 Effects of Termination

All sections that by their nature should survive termination of these Terms will continue in full force and effect. Termination will not limit any of my other rights or remedies.

9. General Provisions

9.1 Updating These Terms

I may modify these Terms from time to time, in which case I will update the "Last Revised" date at the top. If I make material changes, I will make reasonable efforts to notify you, such as by email or through a notice in the App. However, it is your responsibility to review these Terms periodically.

Updated Terms will be effective upon posting, or a later date that may be specified. Your continued access to or use of the Services after modifications have become effective will be deemed your acceptance of the modified Terms.

9.2 Dispute Resolution

Any dispute, controversy, or claim related to these Terms or the Services will first be attempted to be resolved amicably through direct negotiation. You may contact me at hello@getmangahub.com.

If the dispute cannot be resolved amicably within 30 days, it will be submitted to the competent courts of Spain.

9.3 Governing Law

These Terms are governed by the laws of Spain and the European Union. If you are a consumer resident in the European Union, you will also benefit from the mandatory provisions of consumer protection legislation in your country of residence.

9.4 Online Dispute Resolution Platform

The European Commission provides an online dispute resolution platform that you can find at: https://ec.europa.eu/consumers/odr

9.5 Severability

If any provision of these Terms is illegal, void, or unenforceable, such provision will be deemed severable and will not affect the validity and enforceability of the remaining provisions.

9.6 Assignment

These Terms and the licenses granted may be assigned by me but may not be assigned by you without my prior written consent.

9.7 Waiver

No waiver of any breach of these Terms will be deemed a waiver of any prior or subsequent breach.

9.8 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and me regarding the use of the Services and supersede any prior agreements.

10. Apple App Store Specific Terms

The following terms apply if you use the App downloaded from Apple App Store:

- You acknowledge that these Terms are solely between you and me, not Apple, and that Apple has no responsibility for the App or its content.

- Your use of the App must comply with the applicable App Store terms of use.

- Apple has no obligation to provide maintenance and support services with respect to the App.

- In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. Apple will have no other warranty obligation whatsoever.

- Apple is not responsible for addressing any claims of yours or any third party relating to the App, including product liability claims, failure to meet any applicable legal requirements, or consumer protection claims.

- In the event of any third-party claim that the App infringes intellectual property rights, I will be solely responsible for the investigation, defense, and settlement of such claim.

- Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary.
